TERMS AND CONDITIONS

Welcome to Brand Glory Luxuries. By accessing or using our website (the “Store”), you agree to the following Terms And Conditions (“Agreement”). Please review them carefully.

 

1. Description of Services

 

Brand Glory Luxuries provides access to unused, pre-owned and discounted luxury goods, authenticated by our team of experts. All items are offered for sale through our online platform as described in this Agreement.

 

2. Eligibility

 

You must be at least 18 years old to use the Store. By accessing and using the Store, you represent and warrant that you are 18 years or older.

 

3. User Conduct

 

By using the Store, you agree not to:

 

    •    Use the Store for any unlawful purpose, including but not limited to money laundering;

    •    Provide false, misleading, or unauthorized information;

    •    Use the Store to collect market research for a competing business;

    •    Transmit any content that infringes intellectual property rights, is defamatory, obscene, violent, or violates another’s
          privacy;

    •    Stalk, harass, impersonate, or misrepresent yourself;

    •    Interfere with advertisements, security features, or normal operations of the Store;

    •    Place an unreasonable load on our technical infrastructure;

    •    Use any automated methods to access, scrape, or submit postings without prior written consent;

    •    Attempt unauthorized access to Store systems or user accounts.

 

If you see content that violates these rules, please report it to us. We reserve the right to remove content and/or restrict access to users who violate this Agreement.

 

4. Your Account

 

When creating an account, you agree to:

 

    •    Maintain the confidentiality of your login credentials;

    •    Accept responsibility for all activities under your account;

    •    Notify us immediately of any unauthorized use or security breach.

 

We reserve the right to refuse service, terminate accounts, and remove or edit content at our discretion.

 

5. Sales and Transaction Process

 

Shipping and Insurance

 

    •    We ship orders via FedEx and USPS, typically within 48 hours of order receipt (excluding weekends and holidays).

    •    All shipments are insured by Brand Glory Luxuries for the purchase amount until delivery            

          confirmation via signature.

    •    If the carrier cannot obtain a signature, an instruction card will be left. If the package is unclaimed within the carrier’s time
          limit, it may be returned to us. We will contact you to arrange        

          reshipment.

Cancellations


Once an order is placed, our fulfillment process begins immediately, including order verification, internal handling, and non-refundable credit card processing. Because of this, we are unable to offer cancellations, even if the item has not yet shipped. If you have any questions prior to purchasing, we encourage you to contact our team for assistance.

 

Returns

 

    •    Returnable items must be eligible for return and must be approved by Customer Service.    

          Approved returns will receive an RMA (Return Merchandise Authorization) number along with

          return instructions.

    •    Items sold “As Is” are final sale and not eligible for return. Items purchased at Trunk Shows or

          Pop-Up events are also final sale and not eligible for return.

    •    Items eligible for return include all other items that are significantly misrepresented.

    •    If a return is approved due to material misrepresentation, the item must be returned in the same condition it was delivered
          in. We cannot accept returned items that have been worn, altered, or    

          damaged. Items with odors such as smoke or perfume will not be accepted. All original tags must

          be attached.

    •    To return eligible items, you must request an RMA within 3 days of the delivery date (as reported

          by the courier) and initiate the return within 3 days of receiving the RMA using the label provided.

    •    Handbags, shoulder bags, purses, clutches, wallets, or belts listed in “As Is” condition are FINAL

          SALE and may only be returned if Customer Care confirms a material misrepresentation by Brand

          Glory Luxuries.

    •    Returned packages are opened and inspected under video recording for verification purposes. We

          reserve the right to reject deliveries that appear opened, tampered with, or damaged.

6. Authenticity and Brand Affiliation

    •    Brand Glory Luxuries is not affiliated with, endorsed by, or an authorized retailer of any of the    

          brands sold.

    •    All products are independently sourced and authenticated by qualified professionals.

    •    Brands sold through the store are not involved in the authentication process and are not

          responsible for goods sold.

    •    Items do not include manufacturer warranties, after-sales service, or boutique-specific packaging,

          unless specifically stated.

    •    Some items may be in unused or “Pristine” condition; however, these descriptions reflect the

          item's visible condition only — not its retail origin or status as "brand-new" under manufacturer standards.

    •    Our condition terms, including Pristine, Unused, and Like New, are intended to convey the

          physical and visible state of the item. These items may not have been worn or owned previously.

    •    We do not describe these items as “new” due to brand restrictions and manufacturer warranty

          limitations, but many are in new, unworn condition unless otherwise noted in the product  

          description.

    •    We guarantee the authenticity of all products. If any item is proven to be counterfeit, we will          

          provide a full refund.

 

7. Intellectual Property

 

    •    All materials on the Store, including software, images, graphics, text, and photographs (“Content”), are owned by Brand
          Glory Luxuries or third parties and protected by copyright and trademark laws.

    •    You may not use, reproduce, distribute, modify, or create derivative works from any Content without our prior
          written permission.

    •    Photographs taken and processed by Brand Glory Luxuries are our exclusive property and may not be reused without
          authorization.

 

If you violate these terms, your right to use the Store and its Content will immediately terminate, and you must destroy any copies you have made.

8. Limitation of Liability


To the fullest extent permitted by law, Brand Glory Luxuries shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Store. In no event shall our total liability exceed the amount paid for the item purchased.

 

9. Governing Law and Dispute Resolution


This Agreement is governed by the laws of New Jersey, without regard to conflict of law principles. Any disputes arising out of this Agreement shall be resolved through binding arbitration in New Jersey, except where prohibited by law.

 

10. Privacy Policy

 

Use of the Store is also subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

 

11. Force Majeure


We are not liable for any delays or failure in performance resulting from events beyond our reasonable control, including but not limited to acts of God, war, strikes, pandemics, supply chain disruptions, or shipping carrier delays.

12. Payment Processor Terms

    •    We accept payments through trusted third-party processors, including Stripe and Affirm (a buy-now-pay-later service
          integrated via Stripe), which securely handle credit card, digital wallet, and installment transactions.

    •    All payment information is transmitted and stored in compliance with Payment Card Industry Data Security Standards (PCI
          DSS) to ensure the safety and confidentiality of your financial data.

    •    Brand Glory Luxuries does not store full credit card details on our servers; all sensitive payment processing is managed by
          Stripe’s secure platform.

    •    Payments are charged immediately upon order placement or in accordance with the terms set by Affirm for installment
          plans. If your payment is declined or a payment plan is not approved, your order will not be processed.

    •    In the case of a payment dispute or chargeback, Brand Glory Luxuries reserves the right to provide evidence such as order
          confirmation, shipping documentation, and authentication certificates to the payment processor or bank to resolve the
          dispute.

    •    We encourage customers to contact our Customer Service team at shop@brandgloryluxuries.com before initiating a
          chargeback to help resolve any concerns directly.

    •    Any fraudulent or unauthorized transactions will be thoroughly investigated and reported to appropriate authorities.

13. Changes to These Terms


We may update these Terms and Conditions from time to time. If we make material changes, we will notify you by email or by posting a notice on the Store. Continued use of the Store after changes take effect constitutes your acceptance of the new terms.
